Important Information
-
Objective Performance and Health Pty Ltd (OPH) is committed to protecting the privacy, confidentiality and security of personal and health information.
This Privacy Policy explains how OPH collects, holds, uses and discloses personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs) and other applicable legal and professional obligations.
Information collected
OPH may collect personal and sensitive information reasonably necessary to provide allied health and related services.
This may include names, dates of birth, contact details, emergency contacts, health and medical information, diagnoses, treatment history, medications, functional information, occupational and employment information, military or service-related information where relevant, referral information, reports, assessment findings, clinical notes, correspondence, billing information, Medicare or DVA information where applicable, and other information relevant to the services being provided.
OPH will only collect information that is reasonably necessary for its functions and services.
How information is collected
Information may be collected directly from an individual through enquiries, appointments, assessments, forms, telephone calls, email, the OPH website and during the provision of services.
Where appropriate and authorised, information may also be received from third parties including referring practitioners, medical and allied health professionals, employers, insurers, rehabilitation providers, government agencies including the Department of Veterans' Affairs, family members, carers or other persons involved in an individual's care or referral.
Where practicable, individuals will be informed when information is being collected from another source.
Why information is collected
Personal and health information may be used for purposes including assessing referrals, determining whether OPH is an appropriate provider, providing health and rehabilitation services, developing treatment or intervention plans, communicating with other authorised parties, preparing clinical reports, coordinating care, managing appointments, processing accounts and claims, meeting professional and regulatory requirements, and maintaining appropriate clinical records.
Information will not ordinarily be used or disclosed for a purpose unrelated to the reason it was collected unless consent has been provided or the use or disclosure is otherwise permitted or required by law.
Consent and disclosure
Health information is sensitive information and will be handled accordingly.
Where consent is required, OPH will seek appropriate consent before collecting, using or disclosing health information.
Information may be disclosed to another person or organisation where the individual has consented, where disclosure is reasonably necessary for the provision or coordination of services and permitted by law, where required or authorised by law, or where otherwise permitted under the Australian Privacy Principles.
Where services are funded, referred or coordinated by another organisation, relevant information may be provided to that organisation where authorised and appropriate. This may include reports, recommendations, progress information, invoices or other information reasonably required for the management of the referral or funding arrangement.
Consent may be withdrawn or changed, subject to legal, clinical, contractual and record-keeping requirements.
Storage and security
OPH takes reasonable steps to protect personal and health information from misuse, interference, loss, unauthorised access, modification and disclosure.
Information may be stored electronically and, where required, in physical form. Reasonable administrative, technical and physical safeguards are used to protect information held by OPH.
Some information may be stored or processed using reputable third-party software, cloud, communications, accounting or practice-management providers.
Access and correction
Individuals may request access to personal information held about them and may request correction of information they believe is inaccurate, out of date, incomplete, irrelevant or misleading.
Requests should be made using the contact details below.
Access may be subject to limitations permitted by law. Where access or correction cannot be provided, OPH will provide an explanation where required.
Retention of records
Clinical and personal information will be retained for the period required by applicable legal, professional, funding and regulatory requirements.
When information is no longer required to be retained, reasonable steps will be taken to securely destroy or de-identify it where appropriate and permitted by law.
Website and electronic communications
The OPH website may collect limited technical information associated with its operation, security and website analytics.
Information voluntarily submitted through website forms, email or other electronic communication may be retained for the purpose of responding to the enquiry or providing services.
While reasonable safeguards are used, transmission of information over the internet carries inherent security risks. Individuals should avoid sending highly sensitive information through unsecured communication channels where a more secure option is available.
Anonymity and pseudonyms
Where lawful and practicable, individuals may make general enquiries without identifying themselves or may use a pseudonym.
It will generally not be practicable to provide clinical services without sufficient identifying information to safely provide, document and coordinate care.
Privacy enquiries and complaints
Questions, concerns or complaints regarding privacy or the handling of personal information should first be directed to OPH.
OPH will review privacy complaints and respond within a reasonable period.
If a privacy concern cannot be resolved directly with OPH, an individual may be entitled to make a complaint to the Office of the Australian Information Commissioner.

TERMS AND CONDITIONS
These Terms and Conditions apply to services provided by Objective Performance and Health Pty Ltd (OPH). By engaging OPH or participating in services provided by OPH, clients acknowledge the following conditions.
Nature and scope of services
OPH provides allied health and related services within the professional qualifications, competence, experience and scope of practice of the treating practitioner.
Acceptance of a referral does not guarantee that every service, assessment, intervention, treatment, report or recommendation requested by a client, referrer, funder or other party will be provided.
OPH reserves the right to determine whether a requested service is clinically appropriate, safe, evidence-informed and within the practitioner's professional scope and competence.
Referral suitability
OPH may decline a referral before services commence or determine following assessment that OPH is not the most appropriate provider for the client's needs.
OPH will not provide an intervention, assessment or opinion where the practitioner does not have the appropriate competence, expertise or professional basis to do so.
Where another practitioner or service is considered better suited to the client's needs, OPH will advise the client or referring party and, where reasonably possible, identify an alternative provider or appropriate pathway. OPH cannot guarantee the availability, suitability, cost, waiting period or outcome of services provided by any third party.
Clinical judgement and professional independence
All assessments, interventions, reports and recommendations are based on the information reasonably available to the practitioner at the relevant time together with clinical assessment, professional judgement, current evidence and applicable professional standards.
A request from a client, referrer, employer, insurer, funding body or other party does not require OPH to provide a particular opinion, recommendation or intervention.
Clinical findings and recommendations will remain independent and will not be altered to achieve a preferred administrative, compensation, employment, funding or other outcome.
Safety and appropriateness of recommendations
OPH will not knowingly provide or endorse an intervention, recommendation, activity, equipment item or course of action considered inconsistent with current safety requirements, applicable professional standards or the practitioner's clinical judgement.
Where a requested intervention is considered unsafe, inappropriate, contraindicated or outside professional scope, OPH may decline to provide or recommend it.
Safety considerations take precedence over the preferences or requested outcomes of a client, referrer, funder or other party.
No guarantee of outcome
Allied health services involve individual responses and outcomes cannot be predicted or guaranteed.
The effectiveness of an assessment, intervention, treatment strategy, equipment recommendation, environmental modification, rehabilitation strategy or other service may vary between individuals and circumstances.
An intervention that is effective for one person may not be effective for another. Some interventions reasonably require trial, review, modification or replacement before an appropriate approach is identified.
The need to modify or discontinue an intervention following review does not, by itself, indicate that the original intervention or recommendation was inappropriate.
OPH does not warrant or guarantee any particular clinical, functional, occupational, rehabilitation, employment, performance, funding or other outcome.
Information provided by clients and third parties
OPH relies on clients, referrers and other relevant parties providing information that is accurate and sufficiently complete to enable safe and appropriate service delivery.
Clients are responsible for informing OPH of relevant changes to their health, symptoms, medications, circumstances, risks or other information that may affect assessment or intervention.
OPH is not responsible for an outcome arising from information that was materially inaccurate, incomplete, withheld or unavailable where the practitioner could not reasonably have been expected to know that information independently.
Recommendations and changing circumstances
Recommendations reflect the circumstances, information and clinical presentation existing at the time they are made.
Health status, functional capacity, environments, equipment, employment circumstances and other relevant factors may change over time. A previous recommendation should not be assumed to remain appropriate indefinitely.
Further assessment or review may be required before implementing an older recommendation or where circumstances have materially changed.
Third-party products and services
OPH may recommend equipment, products, tradespeople, healthcare providers or other third-party services where considered appropriate.
Unless expressly stated otherwise, such recommendations do not constitute a warranty or guarantee regarding a third party's product, workmanship, service, availability or performance.
Third-party providers remain responsible for their own products and services.
Client participation
Clients retain the right to make informed decisions regarding their care and may decline or discontinue an intervention.
Clients are responsible for following relevant safety instructions and advising OPH where an intervention causes unexpected symptoms, difficulties or concerns.
Where safe and effective service delivery depends upon client participation, adherence, attendance, practice or implementation of agreed strategies, outcomes may be affected where these do not occur.
Reports and professional opinions
Reports and professional opinions prepared by OPH are based on the purpose for which the assessment was conducted and the information reasonably available at that time.
Unless expressly stated otherwise, a report should not be relied upon for a materially different purpose without consultation with OPH.
OPH does not guarantee that a recommendation will be accepted, approved or funded by an insurer, employer, government agency, compensation scheme, Department of Veterans' Affairs, funding body or other third party.
Decisions made by those organisations remain outside the control of OPH.
Emergencies and urgent medical care
OPH is not an emergency medical service.
The website, email and other OPH communication channels should not be used to obtain emergency assistance. Individuals requiring urgent or emergency medical assistance should contact an appropriate emergency or medical service.
Website information
Information provided on the OPH website is general information only and is not a substitute for individual assessment, diagnosis, treatment or professional advice.
Website content should not be relied upon to make decisions concerning an individual's health, safety or treatment without obtaining advice appropriate to their circumstances.
Limitation of liability
Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right, remedy or other protection that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.
Subject to those rights and to the maximum extent permitted by law, OPH does not accept liability for loss arising solely from:
(a) an outcome that could not reasonably have been predicted or prevented through the exercise of appropriate professional care and skill;
(b) an individual's failure to follow safety advice, instructions or agreed precautions;
(c) materially inaccurate, incomplete or withheld information supplied to OPH;
(d) changes in circumstances occurring after an assessment or recommendation;
(e) the independent acts, omissions, products, decisions or services of third parties; or
(f) the failure of a third party to approve, fund, implement or accept an OPH recommendation.
Nothing in these Terms is intended to exclude liability where doing so would be unlawful.
Professional standards
Services will be provided in accordance with applicable professional, ethical and regulatory requirements.
Where there is any inconsistency between a request made of OPH and a practitioner's professional or legal obligations, those professional and legal obligations will take precedence.
Changes to these Terms
OPH may amend these Terms and Conditions where reasonably required to reflect changes to services, business practices, professional requirements or applicable law.
The current Terms and Conditions will be published on the OPH website.
Governing law
These Terms and Conditions are governed by the laws of Tasmania and applicable laws of the Commonwealth of Australia.
